Korean Railway Safety Act (2): Safety Management System and Approval Procedures
Introduction: Protecting Railway Safety through Systems
Railway safety does not depend solely on individual attention. In a railway environment where massive personnel and huge equipment move, a sophisticated ‘Management System’ that supports them is essential. In the Railway Safety Act, this is called the ‘Railway Safety Management System (SMS)’.
Understanding who approves this system, in what cases change approval must be obtained, and how the state inspects it is critical for anyone studying the Korean rail industry. Today, we take an in-depth look at Chapter 2 of the Act, which covers the Safety Management System.
1. Establishment and Approval of the Safety Management System (Article 7)
Railway operators or those who wish to perform railway traffic control duties must have a comprehensive safety management system that includes personnel, facilities, vehicles, and operational procedures.
- Approving Authority: Minister of Land, Infrastructure and Transport (The most important keyword).
- Approval Requirement: Approval must be obtained before starting railway operations (or before starting control duties).
- Key Point: It is not about just “having” a system; you can only perform duties after getting ‘Approval’ from the Minister.
2. Change Approval vs. Change Notification (Article 7 Paragraph 3)
When changing the approved contents, you do not have to get approval again in all cases. It is important to distinguish between these two:
- Change Approval: When intending to change ‘Important Matters’ prescribed by Presidential Decree. (e.g., major reorganization of the safety management organization, input of new lines, etc.)
- Change Notification: When minor matters that are not important are changed. (Notification to the Minister within 15 days from the date of change.)
3. Cancellation of Approval and Suspension of Effect (Article 8)
The Minister may cancel approval or order suspension of duties if a railway operator violates the law or does not properly maintain the safety management system.
- Mandatory Cancellation: If approval was obtained by false or other fraudulent methods. (The law says “Shall” cancel.)
- Discretionary Cancellation/Suspension: If the criteria for approval are not met, or if railway operations have not been performed for more than 6 months without justifiable reasons.
4. Inspection of the Railway Safety Management System (Article 9) - Regular vs. Occasional
The state periodically looks into whether the approved system is actually working well in the field.
- Regular Inspection: An inspection conducted periodically every year.
- Occasional Inspection: Conducted unexpectedly when a railway accident has occurred or is likely to occur, or when it is necessary to verify if the approved matters are properly implemented.
5. Safety Reporting and Record Keeping
Railway operators must report safety-related information to the Minister and maintain related records for a certain period. This becomes the basic data for identifying the cause of an accident and improving the system.
Conclusion: Approval and Inspection, Double Locks Toward Safety
The Railway Safety Management System is like a ‘License’ for the railway. It must go through rigorous approval by the Minister of Land, Infrastructure and Transport, and its effect must be maintained through regular annual inspections for trains to move.
